  1. GENERAL

These general terms and conditions apply to all commercial transactions carried out in our online shop, https://azarey.es, hereinafter referred to as the Seller. For more information about The Seller and our Privacy Policy, please refer to the Legal Notice hosted in the footer of this store.

These legal conditions are in line with the various legal regulations related to the virtual sale of products and services, such as Law 7/1996 of 15 January 1996 on the Regulation of Retail Trade (amended by Law 47/2002); Law 34/2002 of 11 July 2002 on Information Society Services and Electronic Commerce (amended by Royal Decree-Law 13/2012 of 30 March); Royal Legislative Decree 1/2007 of 16 November 2007, the General Consolidated Text for the Defence of Consumers and Users; Law 3/2014, of 27 March, amending the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November, Law 44/2006 of 29 December, on improving the protection of consumers and users; Royal Decree 1906/1999 of 17 December 1999 regulating Telephone or Electronic Contracting with general conditions; Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data; the Organic Law on Data Protection and Guarantee of Digital Rights (LOPDGDD); Law 56/2007 of 28 December 2007 on Measures to Promote the Information Society; Law 29/2009 of 30 December 2009, amending the legal regime on unfair competition and advertising to improve the protection of consumers and users; General Telecommunications Law 32/2003 (amended by Royal Decree-Law 13/2012, of 30 March).

The Seller reserves the right to modify these General Terms and Conditions in order to bring them into line with the current legislation applicable at any given time, new case law and customary market practices.

Please read these Terms of Purchase and our Privacy Policy carefully before placing your order. If you do not agree to all of the Terms of Purchase and the Privacy Policy, you should not place any order.

Only persons with sufficient legal capacity to enter into contracts relating to the type of goods and services presented on this website may place orders in the online shop.

By providing their data, the User accepts the legal conditions and the privacy policy of the online store.

The User undertakes to use the online store in accordance with the Law, the General Conditions of Use, the Legal Notice, and other notices, regulations of use and instructions made known to him/her. 

The User undertakes to use the Contents diligently, correctly and lawfully and, in particular, undertakes to refrain from (a) using the Contents in a manner, for purposes or effects contrary to the law, morality and generally accepted good customs or public order; (b) reproduce or copy, distribute, allow public access through any form of public communication, transform or modify the Contents, unless authorized by the owner of the corresponding rights or legally permitted; (c) delete, circumvent or manipulate copyright and other identifying data.

It is forbidden to carry out any type of advertising or commercial information directly or covertly without due authorization, sending mass mailings ("spamming").

 Likewise, it is forbidden to carry out actions that may cause any type of damage to the Seller's systems, or those of its legitimate owners or third parties, in the online store or through it by any means.

Any link made to the contents will require the prior consent of the Seller and must allow, through the appropriate visualization, the identification of its origin. The use of this information on other Internet sites requires express permission.

The Seller reserves the right to deny or withdraw access to the online store and/or its services, at any time and without prior notice, to those users who fail to comply with the General Conditions or infringe any of the precepts established by Law 34/2002, of 12 July, Information Society Services and Electronic Commerce.  

  1. USER REGISTRATION

Access to and use of certain services and applications offered on the Website requires the user to register in advance through a registration form. The data provided by users in this form will be incorporated into an automated processing process owned by the Seller. Such processing will be subject to current data protection regulations. 

Users who contract through the https://azarey.es website acknowledge that they are of legal age. Recruitment carried out by minors requires the prior authorisation of their parents, guardians or legal representatives, who will be held responsible for the recruitment carried out by the minors in their care. 

Speculative, false or fraudulent orders may not be placed. In such a situation, we will be entitled to cancel it and inform the relevant authorities. In the event that an order arouses suspicions of fraud, we may ask the user via email or telephone for their personal data, as well as their ID number or PASSPORT in order to verify that it is not a fraudulent purchase.

For any incident or complaint in relation to their orders, the User may send an email to the e-mail address shop@azarey.es.

The Seller is engaged in the sale of footwear.

The colors of some product photographs may vary from reality.

  1. CONTENTS AND INFORMATION PROVIDED ON THE WEBSITE

The Seller reserves the right to modify the commercial offer presented on the website (modifications to products, prices, promotions and other commercial and service conditions) at any time. The Seller makes every effort to provide the information contained on the website truthfully and without typographical errors. In the event that at any time an error of this type occurs, beyond the control of the Seller at all times, it will be immediately corrected. If there is a typographical error in any of the prices displayed and a customer has made a purchase decision based on such error, the Seller will notify the customer of such error and the customer will have the right to cancel their purchase at no cost to the customer.

The contents of the Seller website may, from time to time, show provisional information about some products. In the event that the information provided does not correspond to the characteristics of the product, the customer will have the right to cancel their purchase at no cost to them.

The Seller is not responsible or liable, directly or indirectly, for any of the information, contents, statements and expressions contained in the products marketed. Such responsibility rests at all times with the manufacturers of such products. The customer understands that The Seller is an intermediary between him and the said manufacturer.

  1. SALES SYSTEM

To make a purchase, the user can send us their order
By using the existing "shopping cart" in the virtual store, the purchase process is very simple and the user will remain guided at all times in the process, the stages of the purchase are as follows:

1.- Choose a product category.

2.- Visualize the product you are interested in. By clicking on each article you will be able to expand the information with more images, description, characteristics, colors, availability, etc.

3.- Select  and add the item to the cart. You can then choose to continue shopping or checkout.

4.- If you want to continue shopping, repeat the process. To access the purchase, you must register as a user by entering your data. If you are already registered on the website, you will only have to enter your e-mail and password as the system will retrieve your data.

5.- Check your shopping cart through the previous option or from any page, by clicking on "cart" at the top right of the screen. You will see a detailed list of selected items, and you can add or remove the ones you want. The total of the purchase will be displayed including shipping costs, the buttons to add other shipping methods.

6.- Check that the details you have entered are correct and click "buy".

7.- Select a payment method

  1. APPLICABLE PRICES AND TAXES. DISCOUNT CODES.

All prices and offers displayed in this online store are only valid for online purchases from www.azarey.es and may be different from those shown in physical or online stores that sell our brand AZAREY.

All products in the online store are understood to have a real price of more than €1, shipping costs not included.

The prices of the products displayed on the Seller's website include the Value Added Tax (VAT) that, if applicable, may be applicable, as well as the shipping costs, which will appear at the end of the order. Prices are shown in € (euros).

Purchases that are to be delivered within the territory of any of the member states of the European Union will be subject to VAT.
Purchases that must be delivered in the territories of non-member states of the European Union, Ceuta or Melilla will be exempt from VAT.

The price of each product will be as shown at all times on our website, except in the case of manifest error. If we discover an error in the price of any of the products you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, the order will be considered cancelled and you will be fully refunded. 

We will not be obliged to supply you with any product at the incorrect lower price if the error in pricing is obvious and unambiguous.

Discount codes will only be applicable one at a time, in the event that due to a technical error two or more are applied at the same time, the company may cancel them in the order leaving only one valid and effective. Discount codes are not applicable during the Sale period or on products with promotions.

  1. PAYMENT METHOD

The Seller offers Users and buyers the possibility to choose between the following payment methods: 

Credit or debit card

The customer will be directed to the secure page of our bank under which their credit card details travel in an encrypted form using SSL, not storing any card data.

All technical, legal or navigational problems arising from access to the LA CAIXA payment gateway cannot be attributed to AZAREY. As soon as the financial institution notifies AZAREY of the payment, AZAREY will proceed to send the purchased products to the user. Check your email. We have sent you an e-mail as proof of the order that you will receive shortly.

 Wire transfer

The transfer must be made within 72 hours after placing the order, otherwise the order will be cancelled and the product will return to the store's stock.

When placing the order, we will send you an email with the account number to which you must make the deposit, indicating the account number of our bank. Once the transaction is received, your order will be prepared in our warehouse and shipped to the address indicated.

It is important that in the concept of the transfer you indicate the order number, as well as your name and surname.

Once we receive the bank transfer to our account number, we will proceed to ship the order to you. Please note that transfers can take up to two days to reflect in our  bank.

Cash on delivery

  1. DEADLINES AND SHIPPING COSTS.

Orders placed will take between 2 and 3 working days to be delivered if you have selected to receive the order by "Home Delivery" and reside in the Peninsula. The deadline will change if it is a holiday period (from August 4 to August 21). If you place an order during this period, the order will arrive between August 22/23.

Delivery times "HOME DELIVERY":

- Spain and Portugal (Peninsula): 48 - 72 hours from receipt of payment. As long as it doesn't coincide with a weekend period.

- Balearic Islands: 8/14 working days from receipt of payment.

- International: 8/15 working days from receipt of payment.

*In extraordinary periods such as Sales, Christmas, Black Friday, etc..., shipments will be subject to availability and may be delayed by 2/3 days.

All shipments and returns are made only through the carriers offered by the Seller.

All orders placed through the website are subject to product stock and availability.

If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option to proceed with the purchase by setting a new delivery date or to cancel the order with a full refund of the price paid.

If the order consists of several products and some or all of them cannot be delivered, and their arrival is expected shortly, the delivery of the entire order will be delayed by a few days. If not, we will send it to you within the indicated period and later the rest postage paid.  

Shipping costs

Shipping costs are divided into several rates, it will all depend on whether you live in Peninsula or not, and/or the country you have selected at the time of registration and the shipping method you have selected.

In the case of charges corresponding to duties and customs, these will NOT be included in the shipping costs indicated on the order form. This amount will be borne by the customer and will vary depending on the weight and volume of the package.

  1. RIGHT OF WITHDRAWAL AND EXCHANGE OF PRODUCTS.

In the event that the Customer is not satisfied with the products received in their order, they may exercise their right of withdrawal, in accordance with the provisions of the General Law for the Defense of Consumers and Users. To do so, you will have a period of fourteen (14) calendar days from the receipt of your order. In order to comply with the withdrawal period, it is sufficient that the communication of this right is notified before the expiry of the corresponding period. The costs incurred for the return of the purchase will be borne by the customer. 

The right of withdrawal shall NOT apply to contracts concerning:

  • (a)The provision of services, once the service has been fully executed, when the execution has begun, with the prior express consent of the consumer and user and with the acknowledgement by them that they are aware that, once the contract has been fully executed by the entrepreneur, they will have lost their right of withdrawal.
  • (b)The supply of goods or services the price of which depends on fluctuations in the financial market which the entrepreneur cannot control and which may occur during the withdrawal period.
  • (c)The supply of goods made up to the specifications of the consumer and user or clearly personalized.
  • (d)The supply of goods that may deteriorate or expire quickly.
  • (e)The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.
  • (f)The supply of goods which, after delivery and taking into account their nature, have become inextricably mixed with other goods.
  • (g)The supply of alcoholic beverages the price of which has been agreed at the time of conclusion of the sales contract and which cannot be delivered within 30 days, and the actual value of which depends on market fluctuations which the trader cannot control.
  • (h)Contracts in which the consumer and user has specifically requested the trader to visit him or her to carry out urgent repair or maintenance operations; if, during that visit, the trader provides services in addition to those specifically requested by the consumer or supplies goods other than spare parts necessarily used to carry out maintenance or repair operations; The right of withdrawal must apply to such additional services or goods.
  • (i)The supply of sealed sound or video recordingsor sealed computer programsthat have been unsealed by the consumer and user after delivery.
  • (j)The supply of daily newspapers, periodicals or magazines, with the exception of subscription contracts for the supply of such publications.
  • (k)Contracts concluded through public auctions.
  • (l)The provision of accommodation services for purposes other than housing, transportation of goods, rental of vehicles, food or services related to leisure activities, if the contracts provide for a specific date or period of performance.
  • (m)The provision of digital content that is not provided on a material medium when the execution has begun with the prior express consent of the consumer and user with the knowledge on their part that consequently they lose their right of withdrawal.

Customized Products

In this case, the return and the right of withdrawal will not be applicable to personalised or custom-made products in accordance with Law 3/2014, of 27 March (article 103). If you buy an item according to your specifications or clearly customized (choice of color of materials, measurement, others), once it has been manufactured, even if it has not been delivered to you, you cannot withdraw from the purchase contract.

The customer can exchange the products received with a maximum time of 14 calendar days from the date of receipt. They may be exchanged for others of equal or greater value from among those displayed in our virtual store, as long as the product to be exchanged is in its original packaging and in the same condition in which it was sent, without having been used under any circumstances. The first exchange will be at the Seller's expense (except during the Sale period or products on sale). The cost of shipping per pair, from the second exchange or to make a return will be borne by the customer and will be 6.99€. The customer must contact our customer service at shop@azarey.es  or by calling us on 649 687 874.

All merchandise must be returned in its original packaging (the black shoe box must be placed in the brown box as it arrived at the customer) and in perfect condition. In case it is not returned in the same original packaging, the Seller will not refund the amount.

Once the goods have been received in our warehouses and the delivery has been verified, the amount paid by the Customer will be refunded, in accordance with the payment method made within a period of no more than 14 calendar days from receipt of the returned goods.  The direct cost of returning the good or service, will be assumed by the client as set out in the LGCU.

In order to exercise the right of withdrawal, the Client must notify the Seller of his/her decision to withdraw from the contract by means of an unequivocal statement (e.g.: a letter sent by post to the following address: BROTHERS A&A INTERNATIONAL SHOES, S.L., with address at C/ TALES DE MILETO, NUMERO 5 – 03203 ELCHE (ALICANTE), or an e-mail to the e-mail address info@azarey.es. The SELLER makes available to the User the following Withdrawal Form, which can be used to present their right to withdrawal or where they can consult the data they must provide. The Seller undertakes to notify without delay the receipt of such withdrawal. 

  1. RETURNS OF DEFECTIVE PRODUCTS OR SHIPPING ERRORS.

The Customer may return, free of charge, any product that has a manufacturing defect or a shipping error.

To do so, you must notify us within 48 hours of receipt of the order by e-mail shop@azarey.es  , indicating:

Order number.

Products to be returned.

Contact phone number.

Reason for return (if it is for defective, broken or error in the item)

Once your proposal has been accepted, you will be notified of its acceptance.

To proceed with the return, the products must be presented in perfect condition if it is a mistaken, unused product; And if possible in their original packaging, we recommend that they are properly packed and protected so that they are not damaged on the return.

Once the goods have been received in our warehouses and the delivery has been verified, the amount paid by the Customer will be refunded, in accordance with the payment method made within a period of no more than 14 calendar days from receipt of the returned goods.  In this case, the return costs will be borne by the Seller.

 

  1. INTERNATIONAL RETURNS.

The customer will be responsible for the management and expense of the return.

  1. COMPLAINTS AND CLAIMS.

The User may send the Seller their complaints, claims or any other comment they wish to make through our email address: shop@azarey.es.

In addition, the Seller has official complaint forms available to consumers and users, which they can request from the Seller at any time through our email address shop@azarey.es.

Likewise, if a dispute arises from the conclusion of this purchase contract between the Seller and the User, the User as a consumer may request an out-of-court dispute resolution, in accordance with Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution in consumer matters.   1. GOVERNING LAW AND JURISDICTION.

Access, browsing and/or use of this online store and contracts for the purchase of services and/or products through it will be governed by Spanish law.

Any controversy, problem or disagreement arising from or related to the access, navigation and/or use of the Website, or with the interpretation and execution of these Conditions, or with the sales contracts between the Seller and the Client, will be submitted to the non-exclusive jurisdiction of the Spanish Courts and Tribunals.
